Terms of Service for Chippewa Luce Mackinac Conservation District Online Plant & Tree Sale Fundraisers

Please read these Terms of Service carefully before placing your order. By participating in the Chippewa Luce Mackinac Conservation District online plant and tree sale fundraiser, you agree to be bound by these terms. This sale is organized by Chippewa Luce Mackinac Conservation District, a local unit of state government, and all profits support local conservation efforts, projects, programs, and educational efforts put on by the Chippewa Luce Mackinac Conservation District.
1. Product Information and Availability
Product Descriptions: We make every effort to provide accurate descriptions and images of the trees and plants offered. However, variations in size, color, and appearance are natural. All plants are sold "as is."
Availability: All plants and trees are subject to availability. In the event an item becomes unavailable after your order is placed, we will contact you to offer a substitute of equal value or a full refund for that item.
Plant Hardiness: The Chippewa Luce Mackinac Conservation District is not responsible for plant health or survival.
2. Ordering and Payment
Order Placement: Orders must be placed through our official online store at www.clmcd.org, in person, or by mail.
Payment: Full payment is required at the time of order placement. We accept [list accepted all major credit cards (Visa, Mastercard, Discover, American Express), check, cash, or money order. All credit card transactions are securely processed through our 3rd party provider: Shopify.
Confirmation: You will receive an email confirmation of your order once payment is successfully processed. Please review it carefully.
3. Order Pickup
Designated Pickup Location: All orders must be picked up in person at your chosen location at the time of order placement.
Pick-up dates and time vary from year to year and at times may be delayed due to unforeseen circumstances.
Missed Pickup: It is your responsibility to pick up your order during the specified times. Due to the perishable nature of the products and limited storage, we cannot guarantee the availability or condition of plants not picked up during the scheduled window.
4. Refunds and Cancellations
All Sales Are Final: As this is a fundraiser involving perishable goods, all sales are final. We do not offer refunds or exchanges for purchased plants or trees, except in cases where we are unable to fulfill your order due to unforeseen circumstances (e.g., severe crop failure).
Damaged Upon Pickup: If you believe an item is significantly damaged or incorrect at the time of pickup, please notify our staff immediately before leaving the pickup site. Once plants leave the pickup site, we cannot be responsible for their condition.
5. Disclaimer of Warranties
The Chippewa Luce Mackinac Conservation District makes no warranties, express or implied, regarding the plants' growth, survival, or performance after they have been picked up. Factors such as planting methods, soil conditions, watering, weather, and pest control are beyond our control.
6. Limitation of Liability
In no event shall Chippewa Luce Mackinac Conservation District, its employees, or volunteers be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of the plants or trees purchased, including but not limited to loss of profits, loss of data, or loss of use, even if advised of the possibility of such damages.
7. Changes to Terms of Service
We reserve the right to update or modify these Terms of Service at any time without prior notice. The most current version will always be posted on our website. Your continued participation in our sale constitutes your acceptance of any changes.
